1. Introduction
These are the Terms & Conditions for Electricians On Call, which advise the rules for using our services; what the Client can expect from us, and the Client’s rights and responsibilities. These Terms & Conditions DO NOT apply to renewables work, Solar PV, EESS (batteries) and EV charge points. Which are covered by our sister company London Charging www.londoncharging.com.
By using the services provided by Electricians On Call the Client is agreeing to these terms, as well as our Terms of Use, Privacy and Cookie policies, therefore please ensure these terms are read carefully before using our services.
2. Services
Our services include but are not limited to:
- Enquiries
- Estimates
- Quotations
- Electrical installations
- Electrical repairs
- Regular servicing and maintenance
- Emergency call outs
- EICR reports
- Guarantees
3. Terminology
‘Us’, ‘We’, or, ‘Our’, refers to Electricians On Call Limited.
‘The Client’, refers to you – the person or organisation for whom we agree to carry out work, and/or supply materials. ‘Operative/s’, refers to the representative’s appointed by Electricians On Call to carry out work.
4. Hourly Rate Work
Our charge to the Client will comprise the cost/s of the following:
- Our labour – this being the amount of time spent by our operative/s carrying out the work, to include all reasonable time spent in sourcing non-stocked materials. Our labour rate is charged in accordance with our current hourly rates.
- Materials supplied by us.
5. Quotations
A quotation is a fixed price which, inclusive of labour and materials, will be given to the Client as a firm cost. However, where the circumstances arise as outlined below, the quotation may be revised:
- The Client provides written or verbal instructions to carry out additional work not included in the quotation.
- There is an increase in the price of materials.
- We discover further work that needs to be carried out which could not have been anticipated when the quotation was prepared.
- It is discovered that there was a manifest error when the quotation was prepared.
6. Estimates
An estimate is an approximated figure which is subject to change.
7. Additional Costs
If a detailed report for insurance purposes is required (in addition to the estimate or quotation and invoice) it will carry a nominal charge of £25.00.
8. Offers & Incentives
At our discretion from time to time we may promote offers and/or incentives. These will be clearly defined and will include any specific terms and conditions. Offers and incentives may not be used in conjunction with each other unless authorised by us.
9. Invoices & Payment
Upon the Client’s agreement for us to carry out work for which we have provided a quotation, we reserve the right to charge a deposit payment of up to 50% of the total payable. This is payable immediately. We reserve the right to request, at our discretion, full payment in advance of carrying out the work.
Upon completion of the work we will invoice the Client and our payment terms will be clearly outlined on the invoice. We reserve the right to accrue and charge interest on any part of an invoice which remains unpaid, at a rate of 4% over the Bank of England base rate, until we receive payment in full.
10. Timekeeping
We will use reasonable endeavour to attend at an agreed time for the work to be carried out. However, we accept no liability in respect of the non-attendance or late-attendance on site should this be as a result of circumstances beyond our control. We accept no liability for the late or non-delivery of materials.
11. Cancellation
We require 24-hours notice before a scheduled booking if the Client needs to cancel or rearrange it; this should be made by telephone. Cancellations made further in advance should also be made by telephone and the Client should request written confirmation from us, so they are not liable to be charged.
Should the Client cancel their instructions less than 24-hours before a scheduled booking, or materials being supplied, they may be liable for the cost of any time and materials incurred by us, as well as the profit that would have been made by us, in accordance with the original instructions.
We reserve the right to stop work in progress or cancel the booking due to bad weather conditions which are not allowing us to perform the required service. We reserve the right to refuse, cease or stop the service process at any time if our operatives are abused or threatened in any way.
12. Delays
In the event of delays to work being carried out being the responsibility of the Client, we reserve the right to charge the Client for time lost and travel expenses incurred.
13. Site Access
Prior to our arrival on site, the Client should ensure that areas where work is to be carried out is free from obstructions, such as furniture, toys, ornaments, etc. Where work is to be carried out such as changing a consumer unit in a cupboard, the Client should ensure that there is easy access to the unit, emptying the cupboard if need be. Equally important is to ensure that the circuits to be worked on, may be turned off. This means leaving rooms.
14. Completion of Works
We will leave the site tidy upon completion of works. We will not be liable for any ‘making good’ where decoration has become affected as a result of the agreed works. For example, after ‘chasing out’ walls when carrying out a rewire, we will not be liable for replastering the walls, nor paying for the cost of replastering the walls.
15. Satisfaction
Electricians On Call are committed to providing a top quality, professional service to our Clients. If, once work has been completed, the Client is not satisfied with our service/s they should provide us with written notification of this within 12 months, clearly stating the reasons for their dissatisfaction. The Client should allow us, and our insurer, the opportunity to inspect and carry out remedial works should this be appropriate. Should the Client fail to notify us as outlined above, we will not be liable in respect of any defects in the work carried out.
16. Guarantee
We provide a 12-month guarantee on labour carried out by an Electricians On Call operative. This is in respect of faulty workmanship only. This comes into effect from the date of completion of the work and is in addition to any manufacturer’s warranty/warranties.
The guarantee will become null and void if the work/service/appliance supplied by us is subject to misuse or negligence, or repaired, modified or tampered with by anyone other than an Electricians On Call operative. In the event that materials have been supplied by the Client, we will accept no liability for their damage or fault.
We will not guarantee any work undertaken on instruction from the Client and against the written or verbal advice of the operative.
Only work directly undertaken by us, for which we have been fully paid, will be guaranteed by us. Non-related faults arising from work which has not been undertaken by us will not be guaranteed.
17. Liability
We will only be liable for rectification of our own guaranteed work. We will not be held responsible for any ensuing damage or claims which result from other work overlooked or subsequently requested and not undertaken at the time.
Where recommended work has not been carried out, we will not be held liable or responsible for any damage or defect resulting from work not fully guaranteed.
We shall not be held liable for any delay, or consequences of any delay, in performing our obligations if such a delay is due to any cause beyond our reasonable control and we shall be entitled to reasonable compensation time extensions.
18. Goods
All goods supplied by us and delivered to the Client, or on the Client’s premises, shall remain the property of Electricians On Call until paid for in full by the Client.
19. General
These Terms & Conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative and the Client. Our Terms & Conditions will prevail over any Terms & Conditions used by the Client or contained, set out or referred to in any documentation sent to us by the Client. By entering into a contract with us the Client agrees irrevocably to waive the application of any of these Terms & Conditions.
These Terms & Conditions are subject to change at any time by Electricians On Call. These Terms & Conditions, and all contracts awarded between us and the Client, shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law.
